Telehealth Consent Agreement
You have requested Madison Meds to connect you with a licensed physician (“Physician”) who will review the health details you provide through our online telehealth platform (the “Service”). The Physician will determine whether any Madison Meds weight loss products or services are medically suitable for you (the “Physician Consultation”). This Consent form explains telehealth services and obtains your permission to receive care via telehealth through Madison Meds.
The terms “you” and “your” refer to the individual using the Service, or if the user is a minor (ages 13–18 or older if state law requires), the parent or legal guardian providing consent on their behalf.
Please read this carefully. By selecting “I Agree,” proceeding with the Physician Consultation, or otherwise using the Service, you confirm that you understand and accept the following terms:
What is Telehealth?
Telehealth means delivering healthcare services remotely through electronic communication, such as phone calls, video chats, messaging, or electronic transfer of medical records. This allows diagnosis, treatment, prescribing, education, and follow-up care without needing to be in the same location as the Physician.
Benefits of Telehealth
- Easier access to healthcare services
- Ability to receive care at convenient times and locations
- More efficient management of your health needs
Potential Risks of Telehealth
- The inability to conduct a physical examination may limit the Physician’s ability to fully evaluate your condition
- Technical problems, including software or hardware failures, may affect the quality or timeliness of care
- Privacy risks may arise from electronic transmission of your health information despite security measures
- Loss or unauthorized disclosure of your personal health data is possible, though Madison Meds takes steps to protect your information
Consent to Telehealth Services
By using this Service, you agree to receive healthcare via telehealth. The Physician may decide at any time that telehealth is not appropriate for your care and may discontinue your telehealth services. If this occurs, you agree to stop using the telehealth Service immediately.
Right to Withdraw Consent
You may revoke your consent to receive telehealth care by notifying Madison Meds in writing. This revocation takes effect once received but does not affect any care provided before the revocation. Please note Madison Meds and its Physicians do not offer in-person services; therefore, withdrawal means telehealth care will end.
State Availability and Licensing
Madison Meds’ services are provided by U.S.-licensed healthcare providers and U.S.-registered compounding pharmacies. Because medical practice and pharmacy laws vary by state, not all treatments are available in every state. Eligibility is determined during intake based on the state in which you reside, the specific treatment requested, and provider licensing. If a treatment is not available in your state, you will be notified during or before intake and will not be charged for a consultation that cannot be completed. Emergency Situations
This Service is not intended for emergency medical or mental health care. In case of a medical emergency, call 911. If you are experiencing a mental health crisis or suicidal thoughts, contact the Suicide and Crisis Lifeline at 988.
Protection of Your Information
Madison Meds and its Physicians use appropriate technology and protocols to safeguard your health information under HIPAA. However, complete security cannot be guaranteed for the electronic systems you use to access the Service. Communications containing protected health information may be sent via phone, email, or other electronic means.
No Guarantee of Prescription or Results
Use of the Service does not guarantee that a prescription will be provided or that any specific health outcomes will be achieved.
Accuracy of Your Information
You agree to provide truthful and complete health information. Inaccurate or incomplete details may negatively affect your care. The Physician will rely solely on the information you provide during your consultation.
Payment Terms
Payments you make cover the telehealth Service, Physician Consultation, and any medications prescribed. Madison Meds and Physicians do not bill insurance or third parties on your behalf.
Responsibility for Follow-Up Care
You are responsible for arranging and paying for any follow-up treatments beyond the telehealth Service.
Medication Dispensing and Delivery
If prescribed, your medication will be sent to a Madison Meds affiliated pharmacy for fulfillment and shipped to the address you provide. Please ensure your delivery address is accurate and secure.
Sharing of Health Information
By consenting, you authorize Madison Meds and its Physicians to share your protected health information with pharmacies and other entities involved in your care, as detailed in our Privacy Policy.
Accessing Your Medical Records
You may request copies of your medical records related to this Service by contacting Madison Meds in accordance with applicable laws.
Filing Complaints
- For issues regarding Physicians, contact your state medical board.
- For concerns about pharmacies, contact your state pharmacy board. Madison Meds provides relevant contact information on our website.
By clicking “I Agree” or continuing to use the Service, you acknowledge that you have read, understood, and accept this Telehealth Consent Agreement.
Website Terms of Use
The following additional terms (the “Website Terms”) govern your use of the madisonmeds.com website and any related online services (collectively, with the Service described above, the “Platform”). By accessing or using the Platform, you agree to these Website Terms in addition to the Telehealth Consent Agreement above.
Eligibility
You must be at least 18 years old (or the age of majority in your state) and a resident of the United States to use the Platform for medical services. By using the Platform, you represent that you meet these requirements and that all information you provide is true, accurate, current, and complete.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. Madison Meds is not liable for losses arising from unauthorized account access caused by your failure to safeguard credentials.
Acceptable Use
You agree not to: (a) use the Platform for any unlawful purpose; (b) impersonate any person or misrepresent your identity or medical history; (c) resell, redistribute, or transfer any prescription medication obtained through the Platform; (d) attempt to gain unauthorized access to the Platform or its systems; (e) interfere with or disrupt the Platform; (f) scrape, crawl, or collect data from the Platform using automated means; or (g) use the Platform in any manner that could damage, disable, overburden, or impair it.
Intellectual Property
All content on the Platform — including text, graphics, logos, images, product names, photographs, video, audio, code, and the selection and arrangement of the foregoing — is owned by or licensed to Madison Meds and is protected by U.S. and international intellectual property laws. “Madison Meds” and the Madison Meds logo are trademarks of Madison Meds. You may not use, reproduce, distribute, modify, or create derivative works from any Platform content without our prior written permission, except as expressly permitted by these Terms.
User Content and Feedback
If you submit reviews, testimonials, suggestions, or other content to the Platform, you grant Madison Meds a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, and display that content for any purpose, including marketing, in any media. You represent that you own or have the right to submit such content and that it does not violate anyone’s rights.
Third-Party Links and Services
The Platform may contain links to third-party websites or services, including affiliated telemedicine providers and compounding pharmacies. We are not responsible for the content, privacy practices, or conduct of any third party. Your use of third-party services is governed by their own terms and policies.
Disclaimers
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MADISON MEDS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SPECIFIC MEDICAL OUTCOME WILL BE ACHIEVED.
The content on the Platform is for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MADISON MEDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID TO MADISON MEDS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED DOLLARS (US$100).
Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for gross negligence, willful misconduct, or personal injury caused by our professional negligence where such limitation is prohibited).
Indemnification
You agree to indemnify, defend, and hold harmless Madison Meds and its officers, directors, employees, providers, pharmacies, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any information or content you submit.
Binding Arbitration and Class-Action Waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform (each, a “Dispute”) will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. Arbitration will be conducted in Palm Beach County, Florida, or by videoconference, at your election. The arbitrator’s decision will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver: You and Madison Meds agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over a class or representative action.
Opt-out: You may opt out of this arbitration provision by sending written notice to Madison Meds at ask@madisonmeds.com within thirty (30) days of first accepting these Terms, stating clearly that you wish to opt out of arbitration and including your full name and address. Opting out will not affect any other term.
Exceptions: Either party may (a) bring a qualifying claim in small-claims court, or (b) seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the arbitration provision above, any action that is not subject to arbitration must be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.
Termination
We may suspend or terminate your access to the Platform at any time, with or without cause or notice. Upon termination, provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, arbitration, and governing law) will continue to apply.
Changes to These Terms
We may update these Terms from time to time. Material changes will be posted with a new effective date, and, where required by law, we will provide additional notice. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
Accessibility
Madison Meds is committed to making our Platform accessible and usable by people with disabilities. If you encounter an accessibility barrier, please contact us at ask@madisonmeds.com and we will work in good faith to address it.
Miscellaneous
These Terms, together with the Privacy Policy, HIPAA Notice, Refund Policy, and other policies referenced here, constitute the entire agreement between you and Madison Meds regarding the Platform. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
